Terms of Service

These terms are an agreement between you and [Company legal name] ("Studsmith", "we", "us"), [Registered address]. They cover the Studsmith desktop app, the website and the services behind them (together, the "Service"). By creating an account or using the Service you agree to them.

1. Who can use Studsmith

You must be at least 13 years old to create an account. If you are under the age of majority where you live, a parent or legal guardian must agree to these terms for you and is responsible for your use of the Service, including all purchases. Children under 13 may use Studsmith only through an account created and managed by their parent or guardian.

Only the account holder, or a parent or guardian acting for them, may buy a plan or credits.

2. Your account

Keep your password private and tell us right away at support@studsmith.app if you think someone else has used your account. You are responsible for activity on your account. One person per account; do not share or resell access.

3. Plans, free trials and automatic renewal

Studsmith is sold as a monthly subscription. Each plan includes a number of credits every month, as described on the pricing page at the time you subscribe.

Free trial. New accounts may start one free trial of 3 days. A valid payment method is required to start it. Unless you cancel before the trial ends, your subscription starts automatically and your payment method is charged the plan price at the end of the trial and then every month until you cancel. The date of the first charge is shown before you confirm. One trial per person and per payment method; we may refuse or end trials that appear to be abused.

Renewal. Subscriptions renew automatically each month at the then current price until cancelled. If we change the price of your plan we will tell you at least 30 days before the change takes effect, and you may cancel before then.

Cancelling. You can cancel at any time from your account page in one click. Cancelling stops future charges. You keep access until the end of the period you have paid for (or until the end of the trial). Payments already made are handled as described in the Billing and Refunds policy.

Payments. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns, and its Buyer Terms apply to your purchase. Prices are in US dollars; Paddle adds sales tax or VAT where required. If a payment fails it may be retried and your access may pause until it succeeds.

4. Credits

Credits are a unit for measuring use of the Service, such as planning and building with AI models. Different actions and different models use different amounts of credits; the app shows how many credits each action used. Credits:

• are a licence to use the Service, not money, and have no cash value;
• cannot be sold, transferred, exchanged for money or used outside Studsmith;
• included with a plan and bought in packs remain on your account while you have an active plan, and are kept for 12 months after your plan ends in case you come back;
• may be adjusted if they were added by mistake, through a reversed payment, or through abuse.

We may change how many credits actions use, for example when model costs change. We will not reduce credits you already hold.

5. Your games and content

You own the games, code, files and other material you create with Studsmith ("Your Content"), to the extent the law allows. Your projects are stored on your own computer. You give us a limited licence to process the prompts, files and attachments you send us only so we can provide the Service, as described in the Privacy Policy. We do not claim ownership of Your Content.

AI generated output can be similar to output produced for other people, and we cannot promise that output is unique, error free, or free of third party rights. Review what is built before you publish it.

6. Acceptable use

Do not use Studsmith to create content that breaks the Roblox Terms of Use or Community Standards, the law, or anyone's rights. In particular, do not use it to make exploits, cheats, malware, backdoors or tools to harm other games or players; content that is sexual, hateful, violent in a realistic way, or that targets real people; or real money gambling. Do not try to break, overload, reverse engineer or get around limits of the Service, or resell it. We may suspend or end accounts that do.

7. Roblox

Studsmith works with Roblox Studio but is not made by, endorsed by or affiliated with Roblox Corporation. Roblox, Roblox Studio and related marks are trademarks of Roblox Corporation. Your use of Roblox is governed by Roblox's own terms.

8. Third party services

Studsmith uses third party services, including AI model providers, payment processing and open source tools such as Rojo, Selene and StyLua, which have their own licences. We are not responsible for third party services we do not control.

9. Changes and availability

We improve Studsmith continuously and the app updates itself. We may add, change or remove features and models. We aim for the Service to be available but do not promise it will always be uninterrupted or error free.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT ALLOWED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. Keep backups of your projects.

11. Limitation of liability

TO THE EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Nothing in these terms limits rights you have under consumer law that cannot be limited.

12. Ending your account

You can stop using Studsmith and ask us to delete your account at any time. We may suspend or end your account if you break these terms, with notice where reasonable.

13. Governing law and disputes

These terms are governed by the laws of [State or country], without regard to conflict of laws rules. Before filing a claim, please contact us at support@studsmith.app so we can try to resolve it.

14. Changes to these terms

We may update these terms. If a change is material we will tell you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the new terms.
